These Terms of Use (“Terms”) govern your access to and use of Tokfira’s website, applications, tools, integrations, features, content, and related services (collectively, the “Service”).
By accessing, creating an account for, connecting to, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Tokfira may update these Terms from time to time. Your continued use of the Service after updated Terms become effective means that you accept the revised Terms.
Tokfira is a platform designed to help teams organize, define, map, normalize, export, and publish design-system values such as design tokens, colors, typography, spacing, radii, variables, and related interface styles.
Tokfira may allow you to connect external tools, import or create token libraries, identify inconsistencies, generate variables, prepare exports, or otherwise assist with design-system workflows.
The Service is intended to support your workflow. It does not replace professional design review, engineering review, accessibility testing, quality assurance, security testing, code review, deployment procedures, or backup practices.
You must be at least 18 years old and legally able to enter into these Terms.
If you use the Service on behalf of a company, organization, client, employer, or other entity, you represent and warrant that you have the authority to accept these Terms on that entity’s behalf. In that case, “you” and “your” refer to both you and that entity.
You are responsible for maintaining the confidentiality of your account credentials, passwords, access tokens, API keys, integration permissions, and other access methods associated with the Service.
You are responsible for all activity that occurs through your account, including activity performed by authorized team members, contractors, employees, collaborators, or anyone who gains access through your credentials.
You must notify Tokfira promptly if you believe your account, credentials, connected application, or integration has been accessed without authorization.
Tokfira is not responsible for losses resulting from your failure to protect your account, credentials, permissions, API keys, or connected services.
You retain ownership of the content you upload, import, create, connect, generate, publish, export, or otherwise make available through the Service, including design tokens, style libraries, Figma files, CSS variables, code, configuration files, brand assets, design systems, projects, and related materials (“Your Content”).
You are solely responsible for:
Ensuring that you have all necessary rights, permissions, licenses, and approvals to use, upload, connect, process, export, modify, or publish Your Content through Tokfira.
Reviewing all generated, suggested, mapped, normalized, exported, or published outputs before using them.
Testing outputs in development, staging, preview, sandbox, or other non-production environments before deployment.
Verifying compatibility with your design files, repositories, websites, applications, frameworks, third-party services, hosting providers, browsers, devices, plugins, and production environment.
Maintaining appropriate security, version control, change-management, quality-assurance, accessibility, compliance, and deployment procedures.
Ensuring that your use of Tokfira does not violate any law, regulation, contract, intellectual-property right, confidentiality obligation, or third-party policy.
Tokfira does not assume responsibility for the accuracy, completeness, suitability, security, legality, accessibility, performance, compatibility, or production readiness of Your Content or any output generated through the Service.
You are solely responsible for maintaining complete, current, and independent backups of your work before using Tokfira.
Before connecting, importing, mapping, editing, exporting, publishing, syncing, applying, or deploying any output from the Service, you should create and maintain backups of your original files, design systems, Figma files, code repositories, website files, databases, project configurations, API keys, environment variables, hosting settings, and any other relevant materials.
Tokfira strongly recommends that you use version control, maintain restore points, keep export copies, preserve original source files, and test all changes outside of production before applying them to a live website, app, platform, or customer-facing environment.
Tokfira is not responsible for any loss, corruption, deletion, overwrite, misconfiguration, interruption, broken layout, visual inconsistency, code error, security issue, loss of search ranking, accessibility issue, integration failure, website outage, app malfunction, database issue, data loss, loss of revenue, customer complaint, or other consequence arising from your use of the Service or your failure to maintain backups.
The Service may connect with, rely on, or allow you to use third-party platforms, applications, APIs, plugins, hosting services, repositories, design tools, analytics services, authentication providers, or other external services.
Your use of third-party services is governed by the terms, privacy policies, permissions, pricing, availability, and technical requirements of those third parties.
Tokfira does not control and is not responsible for:
The availability, security, functionality, policies, changes, errors, outages, limitations, or discontinuation of third-party services.
Any permissions, data access, tokens, credentials, or authorizations that you grant to third-party services or integrations.
Changes made by third-party platforms to their APIs, authentication methods, pricing, features, permissions, documentation, file formats, or technical requirements.
Any loss or damage caused by a third-party service, integration, plugin, repository, hosting provider, design tool, browser, framework, or other external system.
You are responsible for reviewing and managing the permissions you grant to Tokfira and to all connected third-party services.
Tokfira may provide tools, suggestions, generated outputs, mappings, exports, normalization workflows, previews, or other functionality intended to assist with design-system and interface-management tasks.
However, Tokfira does not guarantee that the Service or any output will be accurate, complete, error-free, secure, compatible, accessible, compliant, suitable for a particular purpose, or ready for production use.
You understand that automated, assisted, or generated outputs may contain errors, omissions, inconsistencies, unsupported values, incorrect mappings, unexpected formatting, technical conflicts, or other issues.
You are solely responsible for reviewing, validating, testing, approving, and deploying any output created, modified, exported, published, or suggested through the Service.
You may use the Service only in compliance with these Terms and applicable law.
You may not use the Service to:
Violate any law, regulation, court order, contractual obligation, or third-party right.
Upload, process, distribute, or publish content that you do not have the right to use.
Infringe intellectual-property rights, privacy rights, publicity rights, confidentiality obligations, or data-protection obligations.
Introduce malware, viruses, harmful code, unauthorized scripts, or attempts to interfere with the Service.
Attempt to gain unauthorized access to Tokfira, another user’s account, connected systems, APIs, infrastructure, or data.
Reverse engineer, copy, scrape, reproduce, resell, rent, lease, sublicense, or exploit the Service except as expressly permitted by Tokfira.
Use the Service in a way that could damage, disable, overburden, disrupt, or impair the Service or another user’s access to it.
Use the Service to process highly sensitive data unless expressly authorized by Tokfira in writing.
Tokfira may suspend or terminate access to the Service if it reasonably believes that you have violated these Terms, created a security risk, misused the Service, or exposed Tokfira, its users, or third parties to potential harm or liability.
Tokfira and its licensors retain all rights, title, and interest in and to the Service, including its software, interface, workflows, documentation, branding, designs, trademarks, features, visual elements, content, and underlying technology.
Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
You may provide suggestions, ideas, feedback, comments, or recommendations about Tokfira. You agree that Tokfira may use that feedback without restriction or compensation to you.
Tokfira may modify, improve, suspend, limit, discontinue, or remove any feature, integration, workflow, functionality, or part of the Service at any time.
Tokfira does not guarantee uninterrupted, secure, error-free, or always-available access to the Service.
The Service may be unavailable because of maintenance, upgrades, network issues, system failures, third-party outages, security events, changes to external APIs, or circumstances beyond Tokfira’s control.
You are responsible for maintaining your own copies of Your Content and should not rely on Tokfira as your sole storage, backup, publishing, deployment, version-control, or disaster-recovery solution.
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
Tokfira makes no warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, reliability, availability, security, compatibility, or uninterrupted operation.
Tokfira does not warrant that the Service will meet your requirements, preserve your data, prevent errors, detect all inconsistencies, avoid technical conflicts, maintain compatibility with external services, or produce results suitable for use in production.
Your use of the Service is at your own risk.
To the maximum extent permitted by law, Tokfira and its founders, officers, employees, contractors, affiliates, licensors, suppliers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising out of or related to your use of, inability to use, or reliance on the Service.
This includes, without limitation, damages or losses related to:
Lost, altered, corrupted, deleted, overwritten, inaccessible, or unavailable data.
Website, application, server, database, repository, design-file, or integration failures.
Broken layouts, visual inconsistencies, styling errors, code errors, publishing errors, deployment failures, or configuration issues.
Loss of profits, revenue, customers, business opportunities, goodwill, productivity, or anticipated savings.
Security incidents, unauthorized access, credential exposure, API failures, or third-party service issues.
Errors caused by user actions, insufficient testing, lack of backups, incorrect permissions, incorrect configuration, misuse, misunderstanding, or unauthorized use of the Service.
To the maximum extent permitted by law, Tokfira’s total cumulative liability arising out of or related to the Service or these Terms will not exceed the greater of:
The amount you paid Tokfira for the Service during the twelve months before the event giving rise to the claim; or
One hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, Tokfira’s liability will be limited to the maximum extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless Tokfira and its founders, officers, employees, contractors, affiliates, licensors, suppliers, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:
Your use or misuse of the Service.
Your Content.
Your violation of these Terms.
Your violation of any law, regulation, contract, or third-party right.
Your deployment, publication, export, use, or distribution of outputs generated or processed through the Service.
Your failure to maintain backups, conduct testing, obtain permissions, or secure your account and integrations.
You may stop using the Service at any time.
Tokfira may suspend, restrict, or terminate your access to the Service at any time if it reasonably believes that doing so is necessary to protect the Service, other users, Tokfira, third parties, or applicable legal obligations.
Upon termination, your right to use the Service ends immediately. You remain responsible for exporting, preserving, and backing up Your Content before termination or loss of access.
Sections that by their nature should survive termination will remain in effect, including sections concerning ownership, disclaimers, limitation of liability, indemnification, and dispute resolution.
Your use of the Service is also subject to Tokfira’s Privacy Policy.
You are responsible for ensuring that your use of the Service, including any content you upload or connect, complies with applicable privacy, data-protection, confidentiality, and security laws.
Do not upload, connect, or process personal data, confidential information, regulated information, or sensitive data unless you have the legal right and necessary authority to do so.
These Terms will be governed by and interpreted under the laws of the State of New York, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York, New York, and you consent to the jurisdiction of those courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
Tokfira’s failure to enforce any provision of these Terms will not be considered a waiver of that provision.
You may not assign or transfer your rights or obligations under these Terms without Tokfira’s prior written consent. Tokfira may assign its rights or obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar transaction.
These Terms, together with any applicable order form, subscription terms, or privacy policy, constitute the entire agreement between you and Tokfira regarding the Service.
